What a notice must contain

To be a valid notice under §512(c)(3), an email to dmca@loamhand.com needs to include:

Your physical or electronic signature, or that of someone authorised to act for you.
What copyrighted work you say was infringed.
What material you say is infringing, and enough to find it — a link, or which garden and planting it is on, or enough detail that we can locate it by searching.
Your contact details: address, phone number and email address.
A statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law.
A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorised to act for the copyright owner.

A notice missing any of these is not one the law requires us to act on, though we may look into it anyway. We will acknowledge a notice we receive.

What happens next

If a notice is valid, we remove or disable access to the material and tell the member whose account posted it, including a copy of your notice.

The member may respond with a counter-notice if they believe the material was removed by mistake or misidentification. A valid counter-notice needs their signature, what was removed and where it was, a statement under penalty of perjury that they have a good-faith belief it was removed by mistake, their contact details, and consent to the jurisdiction of a federal court where they are found (or, if outside the US, any federal court where Loamhand is found). If we receive a valid counter-notice, we may restore the material in 10 to 14 business days unless you tell us you have filed a court action seeking to keep it down.

Repeat infringers

An account with more than one upheld takedown may lose the ability to upload, or lose the account entirely.
